He also criticized former Prime Minister Silveria Jacobs for her public commentary on the case, which he described as a threat to the integrity of Sint Maarten’s judicial system.

Timeline of the Court Case

The legal battle centers around Secretary General Hensley Plantijn, who initiated proceedings against Sint Maarten's government following a decision he contested. Prime Minister Mercelina explained that the case was first heard by the Court of First Instance, which ruled in favor of the government. Dissatisfied with the verdict, the Secretary-General appealed the decision.

“The appellate court overturned the original verdict rendered by the Court of First Instance,” the Prime Minister stated during the briefing, emphasizing the procedural nature of the case. He outlined the key timeline:

  • December 23, 2023: The Court of First Instance issued its ruling.
  • January 2024: The Secretary General filed for an appeal within the allotted six-week period.
  • March 2024: The government submitted its counterarguments under the previous administration, before the Marcelina Cabinet taking office on May 3, 2024.
  • January 2025: The hearing for the case was held. At this point, Marcelina’s administration was in office.
  • May 21, 2025: The appellate court issued its verdict, overturning the initial ruling in favor of the civil servant.

Mercelina clarified that the government provided a defense during the appeals process and ensured continuity in legal representation, refuting claims of negligence or deliberate inaction.

Addressing Integrity Allegations

Prime Minister Mercelina firmly rejected allegations that his administration failed to uphold good governance or acted improperly during the appeals process. He emphasized that the Marcelina Cabinet was not involved in preparing the case documents, which had been filed prior to his tenure as Prime Minister. Additionally, when the case was active in 2025, another minister (Minister of Justice) was assigned to handle the matter due to potential conflicts of interest.

He said she had previously informed him of her plans to pursue a private sector opportunity before he took office.

“The insinuations of a conflict are baseless. I wish Mrs. Connor Thomas all the best in her career, and we continue to maintain a positive relationship,” the Prime Minister said.
